Share a lease when the tenant dies:We understand that it is difficult to manage someone`s loss and there is much to think about. However, we need to be informed as soon as possible of a tenant`s death. The lease can be transferred to someone else. This is called succession. Details are usually included in your rental agreement. As estate law can be very complicated, we can guide you through the process if you contact us. 4.4 In most cases, we cannot provide you with some or all of our housing or support services without access to your personal data. For example, we need certain personal data to fulfill our obligations under your rental agreement, assistance or care plan, or to process your housing application. As a result, a shared property lease may be terminated by court order under section 7 of the 1988 Act. The only condition is that, since the lease is generally still within the fixed term, the terms set out in Section 7, paragraph 6, must be completed, namely that Basis 2, recital 8 or one of the grounds invoked in Part II of Schedule 2, with the exception of recital 9 or substance 16, and that the lease provides that it be terminated on the land in question, whether by a provision for reintroduction, forfeiture or notice or in some other way. Since a co-ownership lease contains a forfeiture clause similar to that usually found in long leases, it is generally vulnerable to termination by a simple detention measure in the event of a rent arrears or a breach of a tenancy obligation. You can do this by filling out a termination form if you have a guaranteed lease – in general, you have a secure lease if you have been living in one of our homes for 12 months or more.

If you want to share your home, we offer common rentals. This means that all rights and obligations are shared equally and all customers are responsible for the full payment of the rent, even if one of the roommates leaves the landlord. We understand that circumstances change, i.e. if a person no longer wishes to be a tenant or if you have a rental agreement and would like to have a common contract, we can communicate your options if you contact us. The estate law applies only once. Therefore, if one person has already agreed to the lease in these circumstances, there is no other right for another person to inherit the lease.
